Terms & Conditions

Effective August 15, 2026. These Terms & Conditions (“Terms”) govern your access to and use of EzApply websites, forms, content, and related services operated by Oppur2nity LLC (“Oppur2nity,” “EzApply,” “we,” “us,” or “our”). Please read them carefully before using the service.

Acceptance of these Terms

By accessing EzApply, using the website, checking an agreement box, or submitting a request, you acknowledge that you have read and agree to these Terms and the disclosures incorporated by reference, including the Privacy Policy, E-Consent, Credit Authorization, and Advertising Disclosure. If you do not agree, do not use the service or submit information.

These Terms apply to your relationship with Oppur2nity. A lender, provider, lead aggregator, or other third party may give you separate terms that govern its products, communications, decisions, accounts, or services. A lender’s signed agreement controls the terms of any loan.

Eligibility and United States use

EzApply is not a lender

Oppur2nity operates EzApply as a for-profit advertising and lead-generation service. We do not make loans, extend credit, set rates or fees, make underwriting or credit decisions, guarantee approval, fund loans, service accounts, collect payments, or provide financial, legal, tax, or credit-repair advice.

When you submit a request, we may transmit information to participating lenders, providers, or lead aggregators to determine whether an offer or other option may be available. We may receive compensation for a referral, transmission, connection, advertisement, or other qualifying activity. Compensation and provider criteria may influence routing or placement. We do not promise to present every available provider or the lowest-cost or best offer.

No guarantee of an offer or funding

Submitting a request does not constitute a loan application to Oppur2nity and does not guarantee that you will be matched, approved, offered a particular amount, receive particular terms, or receive funds by any date. Participating providers independently determine eligibility, rates, fees, amounts, repayment terms, verification requirements, and funding timing.

Review all provider disclosures carefully before accepting an offer. Contact the identified lender or account servicer—not EzApply—with questions about an offer, signed agreement, funding, payment, existing loan, or collection activity.

Accurate information and authority

Electronic records and signatures

Your consent to receive records electronically is governed by the separate E-Consent presented during the request process. Checking an agreement box or taking another electronic action may constitute your electronic signature where permitted by law. You should retain copies of these Terms, the E-Consent, provider disclosures, and any agreement you sign.

The E-Consent explains applicable hardware and software requirements, how to request paper copies, how to update electronic contact information, and how to withdraw consent. Withdrawing electronic consent does not affect the validity of records provided before the withdrawal became effective.

Credit and consumer reports

A participating provider may obtain a credit report, alternative consumer report, or other verification information when it has a permissible purpose or your authorization. A credit inquiry may be a soft inquiry or a hard inquiry, and a hard inquiry may affect your credit score.

The separate Credit Authorization presented with the request describes the scope of your written instructions and authorization. These general Terms do not independently expand a provider’s right to obtain or use a consumer report beyond the Credit Authorization and applicable law.

Calls, text messages, and email

Communications consent is governed by the specific email and phone/SMS disclosures shown during the request process. If you provide the applicable consent, EzApply, participating providers, or identified marketing partners may contact you at the email address or telephone number you provide, including through automated technology, an automatic telephone dialing system, or an artificial or prerecorded voice where permitted.

Message frequency varies, and message and data rates may apply. You may revoke marketing consent using a reasonable method, including the Remove Me options published on EzApply. Revocation does not prevent communications that are legally permitted without marketing consent, such as certain transactional, security, or request-related communications.

Automated processing

We may use automated rules, algorithms, or artificial-intelligence-assisted systems to validate, review, route, prioritize, secure, or process submissions; prevent fraud; and match requests with potential providers. Automated processing does not guarantee approval, eligibility, placement, or any particular financial outcome.

Participating providers make their own decisions and may use separate automated systems under their own policies and legal obligations.

Permitted use

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use EzApply for your personal, noncommercial, lawful use in accordance with these Terms. No other rights are granted.

Prohibited conduct

Ownership and intellectual property

EzApply’s design, software, text, graphics, logos, trademarks, and other content are owned by Oppur2nity or its licensors and are protected by intellectual-property laws. Third-party names and marks belong to their respective owners. Nothing in these Terms grants a license to use a mark or other protected material except for the limited personal use expressly stated above.

Feedback and communications

Do not send confidential business ideas or proprietary material through general feedback channels. If you voluntarily provide non-confidential feedback about EzApply, you grant Oppur2nity a worldwide, perpetual, irrevocable, royalty-free right to use that feedback to operate, improve, and promote the service without compensation or attribution. This provision does not change our obligations concerning personal information under the Privacy Policy.

Privacy and security

Our collection, use, retention, and disclosure of personal information are described in the Privacy Policy and applicable privacy notices. No online service or transmission method can be guaranteed completely secure. You are responsible for using a secure device and connection and for notifying us if you believe information submitted through EzApply has been compromised.

Do not send Social Security numbers, full bank-account information, passwords, or identity documents through ordinary email, general feedback, or another unsecured channel.

Third-party services and links

EzApply may display, link to, redirect to, or transmit information to third-party websites and services. We do not control and are not responsible for a third party’s content, security, availability, privacy practices, communications, products, decisions, or agreements. A link or connection does not necessarily mean that Oppur2nity endorses the third party.

Your dealings with a lender, advertiser, provider, or other third party are between you and that party. Review its terms and privacy disclosures before providing additional information, accepting an offer, or making a payment.

Service availability and changes

We may modify, suspend, restrict, or discontinue all or part of EzApply at any time. We may correct errors, change features or eligibility, add or remove participating providers, and update content without notice where permitted. We do not guarantee uninterrupted, secure, or error-free operation or that defects will always be corrected.

Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZAPPLY AND ALL CONTENT AND SERVICES PROVIDED BY OPPUR2NITY ARE OFFERED “AS IS” AND “AS AVAILABLE.” OPPUR2NITY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND RESULTS.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPPUR2NITY AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES; OR DAMAGES ARISING FROM A THIRD-PARTY PRODUCT, DECISION, COMMUNICATION, DATA BREACH, OR AGREEMENT, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF OPPUR2NITY AND THE RELATED PARTIES LISTED ABOVE FOR CLAIMS ARISING FROM OR RELATING TO EZAPPLY OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID OPPUR2NITY TO USE EZAPPLY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot be limited under applicable law and do not limit obligations expressly assumed in the Privacy Policy or another written agreement signed by Oppur2nity.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Oppur2nity and its affiliates, officers, employees, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of EzApply, fraud, violation of these Terms, or infringement of another person’s rights. This provision does not require you to indemnify a party for its own unlawful conduct or negligence where prohibited by law.

Informal dispute resolution

Before filing arbitration or a lawsuit, you and Oppur2nity agree to make a good-faith effort to resolve the dispute informally for at least 30 days. A notice must describe the dispute, the relevant account or request information, and the relief sought. Send written notice to Oppur2nity LLC, Attn: Privacy Department, 30 N Gould St. Ste N, Sheridan, WY 82801. Do not include a Social Security number or full financial-account information.

If Oppur2nity needs to send you a dispute notice, we may use the email address, mailing address, or other contact information associated with your request.

Binding arbitration and class-action waiver

PLEASE READ THIS SECTION CAREFULLY. EXCEPT FOR CLAIMS ELIGIBLE FOR SMALL-CLAIMS COURT AND CLAIMS THAT APPLICABLE LAW DOES NOT ALLOW TO BE ARBITRATED, YOU AND OPPUR2NITY AGREE THAT A DISPUTE ARISING FROM OR RELATING TO EZAPPLY OR THESE TERMS WILL BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION INSTEAD OF A JUDGE OR JURY IN COURT.

The Federal Arbitration Act governs this arbitration agreement. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules in effect when the claim is filed, available at adr.org, unless the parties agree to another provider. The arbitration may occur by documents, telephone, video, or in person in the county where you live, as allowed by the applicable rules. Fees will be allocated under those rules and applicable law. If the named provider is unavailable, the parties will select a comparable provider or a court may appoint one.

Arbitration will proceed only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, coordinated, mass, or representative action in arbitration, except to the extent a non-waivable law requires otherwise. The arbitrator may award the same individual remedies a court could award but may grant relief only to the individual claimant and only as necessary to resolve that claimant’s claim.

You may opt out of this arbitration agreement by mailing a signed written notice within 30 days after you first accept these Terms. The notice must state that you opt out of arbitration and include your name, mailing address, and the email address or telephone number used with EzApply. Send it to Oppur2nity LLC, Attn: Privacy Department, 30 N Gould St. Ste N, Sheridan, WY 82801. Opting out of arbitration will not affect the other Terms or your ability to use EzApply.

Governing law and court venue

Except for the arbitration agreement, which is governed by the Federal Arbitration Act, these Terms are governed by the laws of Wyoming without regard to conflict-of-law rules, subject to any non-waivable protections of the state where you reside. A court proceeding not subject to arbitration must be filed in a court with jurisdiction in Sheridan County, Wyoming, unless applicable law requires another location.

Suspension and termination

You may stop using EzApply at any time. We may suspend or terminate access, reject a submission, or take protective action if we reasonably believe you violated these Terms, created security or legal risk, submitted fraudulent or unauthorized information, or misused the service. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, dispute terms, and miscellaneous provisions—will survive.

Changes to these Terms

We may update these Terms by posting a revised version and changing the effective date. Material changes will apply prospectively and will be presented or communicated as required by law. Your continued use after updated Terms become effective constitutes acceptance when permitted by law; if you do not agree to an update, stop using the service.

Notices

We may provide notices through the website, by email or text, or by mail using contact information associated with your request. Electronic notices are subject to the E-Consent. You are responsible for keeping contact information current.

Miscellaneous

These Terms and the incorporated disclosures are the entire agreement between you and Oppur2nity concerning EzApply, except for another written agreement that expressly applies. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. If part of the class-action waiver is unenforceable as to a particular claim or remedy, that claim or remedy will proceed in court after any arbitrable matters are resolved.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. Headings are for convenience and do not limit the Terms.
